Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a contract between you and MailShrine (“MailShrine,” “we,” “us,” or “our”) for use of mailshrine.com, related dashboards, APIs, and the products described below (together, the “Service”). By creating an account, purchasing credits or a mailbox plan, or otherwise using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

If you do not agree, do not use the Service. Questions about these Terms go to legal@mailshrine.com. Product and account support goes to support@mailshrine.com. Privacy requests go to privacy@mailshrine.com or support@mailshrine.com, as described in our Privacy Policy.

2. The MailShrine Suite

MailShrine is a commercial email suite. Under one account, the products that are generally available today are:

  • Email Marketing — campaign, list, and sending tools, billed in sending credits.
  • Business Email — hosted professional mailboxes on domains you control, billed as mailbox plans.
  • AI Email Lead Generator — product-aware discovery of publicly available business and creator contact information, billed in lead credits.
  • Email Sanitization — list hygiene that flags invalid, risky, and duplicate addresses before you send. 200 credits per month, refilled every month.
  • Developer API — REST, SDKs, CLI, webhooks, and SMTP for sending from your product, billed in send credits.

Email Automation is in development. Preview pages, waitlists, and “coming soon” labels do not make that product part of the live Service. When we make a product generally available, these Terms apply to it unless we publish additional product-specific terms.

3. Accounts

You must provide accurate account information and keep your password and access credentials confidential. You are responsible for all activity under your account, including activity by teammates, mailbox users, and anyone you authorize. Notify us promptly at support@mailshrine.com if you believe your account has been compromised.

The Service is not intended for children under 13. You may not use the Service if you are barred from doing so under applicable law.

4. License and Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the hosted Service for your internal business purposes, including commercial use of Email Marketing, Business Email, AI Email Lead Generator, Email Sanitization, and Developer API, in accordance with these Terms and your plan.

This is a license to use the Service, not a sale of our software, branding, documentation, or other materials. MailShrine and its licensors retain all right, title, and interest in the Service. You may not:

  • Copy, modify, or create derivative works of the Service except as we expressly allow in writing.
  • Reverse engineer, decompile, or attempt to extract source code except where that restriction is prohibited by law.
  • Resell, sublicense, or provide the Service to third parties as your own product, except under a separate custom-deployment or partner agreement with us.
  • Remove copyright, trademark, or other proprietary notices.
  • Mirror, scrape, or frame the Service to build a competing product or to bypass plan limits.

You keep ownership of content you submit to the Service (“Customer Content”), including campaign copy, subscriber lists, mailbox messages, domains you bring, and lead lists you generate or export. We may use Customer Content only to provide, secure, and improve the Service, as described in our Privacy Policy.

5. Email Marketing

Email Marketing lets you connect sending accounts (including Gmail, Microsoft, Yahoo, custom SMTP, or MailShrine Cloud where offered), manage lists, compose and schedule campaigns, and view delivery and engagement metrics. List storage does not itself consume sending credits.

One Email Marketing credit is consumed for each email the Service attempts to send on your behalf, unless checkout or in-product help states a different rule for a specific feature. You are responsible for the accuracy of your lists, the content of your messages, the sending identity you use, and honoring unsubscribes and suppressions recorded by the Service.

6. Business Email

Business Email provides hosted mailboxes on a domain you control, together with webmail and related features described in your plan (which may include aliases, calendar, tasks, storage, or other workspace tools). You must have the right to use each domain you connect, and you are responsible for configuring DNS (including MX, SPF, and DMARC) as we instruct.

Mailbox plans are sold as subscriptions, currently billed monthly unless checkout states otherwise. Each plan includes the mailbox count, alias limits, and per-mailbox storage quota shown at purchase or in the billing dashboard. If a mailbox exceeds its storage quota, new mail or uploads may be rejected until you free space or upgrade.

You are responsible for mailbox users you create, their passwords, and mail they send or store. Business Email is not a license to send spam or to use SMTP in violation of Section 10. Non-payment or abuse may result in suspension of sending, mailbox access, or both. If you cancel or a paid plan lapses, you should export mail and files you need before access ends. After the Service for that mailbox ends, we may delete remaining mailbox data in the ordinary course of operations.

7. AI Email Lead Generator

AI Email Lead Generator (“Lead Generator”) is built to help you discover business and creator contact information that is already publicly available on the open web — for example, emails published on public profile, about, contact, or similar pages — and to export lists you intend to use for your own outreach. One lead credit is consumed when a new harvested contact is saved, unless checkout states a different rule.

These Terms permit you to use Lead Generator for that public-source discovery. Public availability of an email address does not, by itself, mean you may email, store, or otherwise process that information under every privacy, marketing, or anti-spam law. You are solely responsible for whether your targeting, collection, storage, enrichment, and later outreach are lawful in each jurisdiction where you operate or where a person is located.

You may not use Lead Generator to:

  • Access private accounts, inboxes, or login-walled data, or circumvent technical access controls.
  • Collect information you know is non-public, stolen, or obtained in violation of law.
  • Target children or harvest data you are not allowed to process.
  • Sell, license, or broker harvested contacts as a standalone data product, list dump, or competing contact database.
  • Misrepresent MailShrine as the sender, controller, or source of your outreach.

We do not warrant that any harvested address is accurate, current, a business address, or lawful for you to contact. You should document sources, apply list hygiene, and review applicable law before sending.

8. Credits, Subscriptions, Storage, and Payments

8.1 Credits

Email Marketing credits and Lead Generator credits are prepaid units of Service usage, not cash, stored value, or a refundable balance. They are not transferable between accounts except as we expressly allow. Pay-as-you-go credits do not expire unless we clearly state otherwise at the time of purchase. Recurring Email Marketing plans grant credits for the billing period described at checkout; unused recurring grants follow the rule shown at purchase or in the billing dashboard.

8.2 Mailbox subscriptions

Business Email is billed as a mailbox subscription for the plan you select. Storage, mailbox count, and feature limits are part of that plan. Changing plans may change those limits immediately. Custom mailbox volume may be offered on request.

8.3 Fees, taxes, and refunds

Prices are as shown at checkout and may be stated in USD or another supported currency. We may change future prices at any time. A price change does not reduce unused pay-as-you-go credits you already purchased. Except where required by law, credit purchases and subscription fees are final and non-refundable, including unused credits. You are responsible for applicable taxes. Failed or past-due payments may suspend the related product.

9. Customer Content, Privacy, and Roles

For Customer Content you upload or create in the Service — including subscriber lists, campaign content, Business Email messages, and Lead Generator inputs and exports — you are the organization deciding why and how that information is processed. MailShrine processes that Customer Content to provide the Service. Our Privacy Policy describes how we handle account, payment, and usage information, and should be read with these Terms.

You represent that you have all rights, notices, and lawful bases needed to submit Customer Content to us and to instruct us to process it, including personal data of your subscribers, mailbox users, and prospects. You must not upload content that infringes others’ rights or that you are not allowed to process.

10. Acceptable Use

You may not use the Service to:

  • Send spam, phishing, malware, or emails that are deceptive, illegal, or that violate anti-spam or consumer-protection law.
  • Impersonate another person or organization, or forge headers, domains, or sending identity.
  • Interfere with or disrupt the Service, other customers, or our infrastructure, including by overloading, scraping our private interfaces, or bypassing rate limits.
  • Probe, attack, or gain unauthorized access to systems, mailboxes, or accounts that are not yours.
  • Use harvested or uploaded data in violation of applicable privacy, employment, export, or marketing law.
  • Violate a third party’s rights, including intellectual property or publicity rights.

We may investigate suspected abuse and may suspend or terminate accounts, withhold sending, or report activity to providers or authorities. Report abuse to legal@mailshrine.com.

11. Outreach, Consent, and Compliance

You are solely responsible for your campaigns, cold outreach, and follow-up, including whether you need consent, another lawful basis, or specific disclosures before contacting someone. Laws differ. For example, some jurisdictions allow certain business-to-business commercial email without prior consent if identification and opt-out rules are met; others (including some GDPR, CASL, and similar regimes) are stricter. These Terms do not authorize any send that applicable law forbids.

When you send through Email Marketing or Business Email, you agree to:

  • Include legally required sender identification and a working unsubscribe or opt-out method where the law requires it.
  • Honor unsubscribes, suppression lists, and do-not-contact requests promptly.
  • Not send to purchased, rented, or scraped lists when doing so would violate law or these Terms.
  • Not treat Lead Generator output as a guarantee that a recipient consented to marketing.

MailShrine may provide unsubscribe links, suppression tools, and educational guides. Those tools help you operate the Service; they do not make us responsible for your compliance, and they are not legal advice.

12. Custom Deployments and Future Developer Functionality

We may offer custom, dedicated, white-label, or customer-hosted deployments, including setup, branding, or single sign-on, under a separate written agreement. Unless that agreement says otherwise, it controls the custom deployment, and these Terms continue to govern your use of the hosted Service at mailshrine.com. Buying SaaS credits or a mailbox plan does not give you a license to copy, host, or redistribute our software.

Email Automation and other preview features may be shown on our website before they are generally available. Preview, waitlist, or documentation access is provided “as is,” may change, and may be withdrawn. Use of the Developer API — including keys, webhooks, SMTP interfaces, and rate limits — is subject to these Terms, the then-current API documentation, and any additional API terms we publish. You may not use preview interfaces or the API to attack, overload, or clone the Service.

13. Suspension and Termination

You may stop using the Service at any time and may cancel a paid mailbox plan through billing controls or by contacting support@mailshrine.com. We may suspend or terminate access immediately if we reasonably believe you have violated these Terms, created risk for other users or our infrastructure, failed to pay, or if we are required to do so by law. We may also discontinue a product with reasonable notice where practicable.

On termination, your license ends. Unused non-refundable credits are forfeited except where law requires otherwise. You should export Customer Content you need before access ends. Sections that by their nature should survive (including intellectual property, payments already due, acceptable use, disclaimers, liability limits, and indemnification) survive termination.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, any particular inbox placement or deliverability rate, the accuracy or lawfulness of Lead Generator results, or that use of the Service will satisfy a regulator, mailbox provider, or recipient.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILSHRINE AND ITS DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO MAILSHRINE FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

16. Indemnification

You will defend, indemnify, and hold harmless MailShrine and its personnel from claims, damages, and reasonable legal fees arising out of: (a) your Customer Content; (b) your campaigns, mailbox use, or outreach; (c) your use of Lead Generator and subsequent contact of people whose information you collected; (d) your domains and DNS; or (e) your violation of these Terms or applicable law.

17. Changes to These Terms

We may modify these Terms by posting an updated version on this page and changing the “Last updated” date. Material changes will apply going forward. If you do not agree to the updated Terms, you must stop using the Service. Continued use after the update constitutes acceptance.
